Legal remedies to bullying in schools.

The South African Schools Act and related legislation address bullying through several mechanisms. They require schools to develop policies that promote a safe environment, enforce disciplinary actions, including suspension and expulsion for severe cases, and involve parents and the community in creating a respectful school culture. The Child Justice Act also emphasizes restorative justice rather than punishment for juvenile offenders, especially those aged 12 and above who engage in bullying behaviors like assault. Additionally, laws such as the Children’s Act 38 of 2005 prohibit abuse and neglect, mandating specific procedures for handling bullying incidents and ensuring the protection of children's rights. Schools must have clear codes of conduct and procedures to prevent, identify, and discipline bullying, with legal accountability if they fail to act.​
